As the lead UN legislative organ in the human rights field, the HRC should engage in an assessment of the multilateral treaty-making process to date, analyze how it might be improved, and consider what contribution the council itself can make. It would be helpful for the council to commission an independent study on the legislative drafting process with recommendations on how the council might approach its legislative role in the future. It would also be desirable for the council to periodically commission expert studies on the need for new standards or for the revision of existing ones. At some stage there should be discussion of the codification or consolidation of international human rights norms, which should include the UN International Law Commission.
The HRC could also play a useful role by tracking the development of customary international law in the human rights field. The council should regularly have its sights on legal gaps in protection. The International Law Commission periodically discusses its future work plan and then adopts a program of work for the coming years that helps it to decide where it can best deploy its resources. The Human Rights Council should also discuss a normative work program periodically and organize its work accordingly. Such planning would allow it to commission expert studies before it discusses new standards in a particular area. In short, the HRCâs legislative role should be steered in the direction of a planned approach rather than an ad hoc one.
